As I understand it, copyright infringment only deals with lost income (at least in the US). If you generate no income (that is, you give your product away) and work in a market that is unlikely to conflict with the copyright holder (that is, your release of the Atari program is considered unlikely to affect the number of Chu Chu Rocket disks sold) then, although you are indeed infringing on copyright, you are not causing harm. Lawsuits on copyright infringment in the US are based solely on the dollar amount of harm done.
This is an entirely different matter than taking a Chu Chu Rocket disk and giving away copies. This alters the number of disks sold, and is indeed harm.
