The problem Scatologic and 4Play had was that they wanted all profits from the game to go to charity. So far, Songbird and Telegames are not willing to do this, so 4Play won't let them make the game.
You are lucky if you have seen BattleSphere on eBay.
Scatologic _are_ able to produce it, it's just it would cost too much for them to do this. This is why there has been (as yet) no 3rd run.
Sorry, but we'll just have to wait until the price of 27C160 chips comes down.
