In fact, the original GEMDOS and GEM sources from Digital Research have been released under the GPL! See Martin Doerings pages for more inforation about this:
http://www.mucl.de/~mdoering/atari/en/index.htm
But the GPL only affects the old DR sources, not the modified TOS version by Atari!
