Converting TOS to other CPUs won't be enough since the programs are compiled for a 68k CPU.

It doesn't matter if all together ask the copyright holder. In fact the topic has been discussed a while ago and the current status is that they're considering releasing the source code - not generally for the public but for interested developers. Building up a qualified group of developers just take time.
