I can only talk from my own experience. I purchased an Eclipse card from Cortex when they first came out. Unfortunately, not matter what I tried, I could not get it to work - I barely got it to work at all!
I contacted Cortex and the original designers (who were very helpful) but still could not get it to work.
Because I live in the UK, I took a day off work and went to Cortex in Birmingham to see if David could help. He manged to get it partially working (it displayed the desktop but was extremely unstable).
A few weeks went by and I decided that I wanted a refund. I contacted Cortex who agreed to provide me a refund (minus postage and fitting) if I sent back my card.
A few weeks went by and I heard nothing. I tried contacting Cortex but only got an answerphone or excuses. In the end, I had to travel up to Birmingham and make a surprise visit before I got my money back!
I hope that you sent back your card registered post and can prove that they received it.
My advice would be to write a letter and send it registered post to Cortex requesting your money back ASAP.
As I said, I can only speak from my own experience of Cortex and would welcome comments from other users/owners of Eclipse, positive or otherwise.

P.S. As far as I am aware, Cortex have NO stock left of the ATI graphics cards... so you could have a long wait!
