I think there is some confusion about MINIX and MINIXFS going on here. MINIX was there first, it was a more or less usable UNIX clone for educational purposes which didn't require a PMMU. It's filesystem, MINIXFS, was made available later as a MiNT filesystem driver, to make MINIX' partitions readable under MiNT. It was then used to build UNIX-Like environments around the MiNT kernel, like SpareMiNT. Most atari users only know 'MINIX' as a term for describing this filesystem driver for MiNT, although MINIXFS is the correct wording, and that causes the confusion.
MINIX has been released for free redistribution, including source code.
